Indiana House Bill 1061 is currently before the Indiana House Judiciary
Committee and will be voted on in less than one week. The new bill will
eliminate the rights of people who have suffered serious injuries from
asbestos exposure to recover compensation for their injuries and medical
costs. Instead, Indiana House Bill 1061 protects the companies who made
deadly asbestos products and knowingly sold them to the general public.
Provisions repealed by the bill will affect product liability cases that
are based on:
- Property damage resulting from asbestos
- Personal injury, disability, disease, or death resulting from exposure
HB 1061 will require certain disclosures for asbestos bankruptcy trust
claims in civil asbestos actions. The bill also provides medical criteria
to set aside and preserve the claims of asbestos and silica claimants
without physical impairment, and gives priority to asbestos and silica
claimants with malignant conditions and impairing nonmalignant conditions.
If passed, HB 1061 will delay asbestos victims access to trials and takes
away their right to participate in a fair civil justice system. Passage
of the bill will not only provide asbestos companies with more protections,
but will also enable these companies to blame the victims for their injuries.
Harmful Effects of Asbestos
The health effects caused by long-term asbestos exposure has been documented.
Asbestos fibers can be easily inhaled and carried into the lower regions
of the lung where they can cause fibrotic lung disease (asbestosis) and
damage the lining of the chest cavity (pleura). Asbestos exposure can
lead to reduced respiratory function and even death. Long-term inhalation
of asbestos fibers also increases the risk of lung cancer and mesothelioma.
