Defective Medical Devices Attorney
Let Us Provide Compassionate Legal Representation for You
Faulty medical devices can be extremely dangerous, causing painful side
effects, costly medical care, and serious, life-threatening health problems.
If a product is defective in design, manufacturing, or implantation, the
person or company responsible for that flaw or mistake should be held
accountable for the damages they caused.
At George & Farinas, LLP, we firmly believe in advocating for the rights
of victims of defective medical devices. Our attorneys are dedicated to
defending the rights of victims wronged by big medical companies, and
we will persistently seek due compensation for your monetary, physical,
and emotional damages.
Understanding Defective Medical Device Cases
When you see your healthcare professional for treatment, you put your trust
in their medical ability, and the safety of the devices they use. If a
product does you more harm than good, or you experience side effects the
manufacturer purposely omitted in their warning, you may have a claim.
Medical devices are supposed to be designed with the safety and health
of the patient in mind, so when a product is produced without due consideration
to safety, the creator is usually liable.
Some of the defective medical device lawsuits we handle include, but are
not limited to:
Hernia Mesh: Used to repair hernias, or tears in the intestine, mesh acts as a sort
of implantation over the injured wall. However, certain hernia mesh products
have proven quite dangerous. Ethicon Physiomesh™ Flexible Composite
hernia mesh was one of the most commonly used products, but was recalled
2016 for causing injuries and severe pain. Side effects include swelling,
bacterial infection, intestinal blockage, reoccurrence of original hernia,
and extreme pain.
Mirena: Created for long-term birth control, Mirena is an intrauterine device
(IUD), which is a “T” shaped device that releases localized
hormones. These devices have been known to migrate, either during implantation
or afterward, and may tear the uterus as a result. There have also been
numerous reports of expulsion, where the IUD is expelled from the body.
Patients have reported cases of pelvic inflammatory disease, perforation
of the uterus, higher risk of ectopic pregnancy, permanent loss of fertility,
blood infections, and ovarian cysts. One of the most recent reports states
that Mirena causes pseudotumor cerebri, a condition that mimics a brain
tumor by causing a build-up of pressure in the skull.
Bard IVC Filters: Installed into the inferior vena cava to prevent blood clots, these spider-like
implants have been known to splinter and break, causing negative side
effects. If the device splinters, fractions can be carried through the
blood stream to the heart or lungs, and possibly causing organ damage.
Side effects include severe heart and chest pain, respiratory distress,
tears in tissues, vessels and organs, pulmonary embolus, and even death.
Nuva Ring: Another vaginal contraceptive device, the Nuva Ring was created by Merck
& Co. and first sold in 2001. The device works by releasing localized
hormones in order to prevent unwanted pregnancy, though certain hormones
were shown to cause problems. It was discovered that the release of progestin
caused venous thromboembolism, a serious blood clotting issue. Unfortunately,
the use of Nuva Ring has since led numerous women to develop more issues,
including increased risk of stroke, heart attack, blood clots, pulmonary
embolism, and loss of vision.
