Bipartisan Opposition to H.B. 1215 Sends Strong Message to Senate

On June 28, 2017, the U.S. House voted on and passed H.B. 1215. The misnamed bill, “Protecting Access to Care Act of 2017”, strips patients and nursing home residents on their rights to pursue litigation in case of injuries or death caused by medical negligence, abuse, or use of dangerous products. It barely slipped past with a small margin of 218-210, with opposite from 19 House Republicans and resistance from all House Democrats. Senate understands just how highly contested this bill is, as it does not have bipartisan support. We at George & Farinas are wholeheartedly against this bills as it strips the American people of the rights they are entitled to.

Never have so many Republicans case so many “no” votes on a tort reform bill, and it is no surprise it is moving to the Senate. H.B. 1215 Along with the American Association of Justice, we at George & Farinas intend to follow this medical malpractice bill in its entirety. We deeply oppose any form of capping in terms of patients’ rights, especially when there are lives on the line. The main point of disagreement is the fact that this bills completely eradicates states’ rights, as states are no longer able to establish their own laws on the matter of noneconomic damages awards to victims, such as pain and suffering.

This cap is deemed unconstitutional by over two dozen states, including Washington and Florida. It’s no surprise this intense increase of federal authority is met with such strong opposition. Likened to “constitutional malpractice”, the Center for Justice & Democracy also strongly condemned this bill’s passing due to the undoubtedly devastating affects it will have on people who have suffered from medical malpractice--including the elderly, children, and sexual abuse victims.
