Congress Rushes Legislation that Punishes Those Receiving Benefits from the Affordable Care Act, Medicare, Medicaid, and the VA

Even before repealing or replacing any of the Affordable Care Acts benefits, Congress has proposed legislation that would punish those who benefit from the ACA. The U.S. House Judiciary Committee recently introduced an alarming piece of legislation, H.R. 1215, referred to as the “Protecting Access to Care Act of 2017”. The title of the bill could not be more

misleading. This bill will negatively impact the ability of victims of medical malpractice to seek compensation if they were injured by a negligent hospital or nursing home, harmed by a drug or medical device, or even going as far as being sexually assaulted by a doctor.

H.R. 1215 also places a cap on compensation for non-economic injuries, such as paralysis, trauma, or reproductive harm, setting the price tag for suffering at $250,000, even in states where such caps have already been declared unconstitutional. Its provisions apply across-the-board, regardless of age or circumstances. Additionally, the mandates provided by this bill will eliminate the power given to juries throughout our judicial system. Instead, it places the power to decide these cases in the hands of DC politicians subject to political special interests.

H.R. 1215 contains many dangerous provisions that threaten core constitutional rights of all American citizens. In response, the American Association for Justice released a statement highlighting its ominous ability to take judicial power from the States and place detrimental restrictions on legal remedies for victims. If passed, H.R. 1215 makes it nearly impossible for justice to be served, and easier for health care providers, and drug and device manufacturers to get away with causing serious injuries and even loss of life.
