The attorneys of George & Farinas have been representing Indiana’s asbestos victims for nearly 30 years. From obtaining the first asbestos verdicts against premise owners and contractors in the 1990’s and early 2000’s, through to the present, we have always fought for the rights of those injured by asbestos in Indiana.
Fighting for You in the Courtroom
In the early 2000’s, an out-of-state attorney lost an Indiana Supreme Court case, Allied Signal v. Ott. This loss effectively eliminated the right to recover from asbestos product manufacturers in Indiana. After this decision, Indiana was deemed by many to be a terrible place to file an asbestos lawsuit, and nearly every asbestos attorney abandoned the State. But not George & Farinas.
We stayed here and fought for Indiana residents. In 2012, George & Farinas won the Indiana Supreme Court case Gill v. Evansville Sheet Metal, ensuring persons injured by asbestos contractors maintained their right to jury trials. In 2016, George & Farinas convinced the Indiana Supreme Court to reverse the outcome of Ott, restoring the rights of those injured by asbestos products to hold the manufacturers responsible. That same year, George & Farinas also successfully convinced the Indiana Court of Appeals not to immunize premise owners from their duty to protect against asbestos hazards on their property.

You’ve likely seen national advertisements for asbestos attorneys. George & Farinas does not engage in such advertising, because when Indiana residents call those national firms, those national firms call us. Presently, every asbestos case in Indiana is filed in Marion County’s consolidated asbestos docket. And every injured person on that asbestos docket is represented by George & Farinas. George & Farinas lawyers Kathy Farinas and Todd Barnes both serve on the committee established to make the Court Rules for this asbestos docket, the only two Plaintiffs’ attorneys on the committee. We’ve never gone away, and we’ve never given up on Indiana residents harmed by asbestos.

Over the past several years, the asbestos and insurance industries have spent incredible resources attempting to pass legislation designed to give asbestos companies advantages in the Courtroom. Kathy Farinas, managing partner of George & Farinas, has repeatedly testified against such legislation in both the Senate and House of Representatives. Not only have we succeeded in ensuring such bills don’t become the law in Indiana, but bills of this nature have been defeated more times in Indiana than in any other state. Working with both sides of the aisle, George & Farinas has ensured that Indiana statutes are fair to those injured by asbestos.
