Lead Paint Injury Cases

Lead is a toxin which is particularly dangerous to children. Exposure to lead can cause learning disabilities, attention deficit disorder, decreased intelligence, and emotional and behavioral problems.

The Centers for Disease Control and Prevention recommend public health actions be taken if a child’s blood lead levels exceed 5 mg/dL, but recognizes “No safe blood lead level in children has been identified.”

Both Federal and Indiana law require persons selling or renting homes built before 1978 to provide prospective purchases and tenants with information about lead hazards.

In 2010, George & Farinas successfully argued Erwin v. Roe before the Indiana Court of Appeals. This case helped establish protections for children injured by lead when landlords fail to properly disclose the lead hazards on their property.
